Terms and conditions of sale

1. Scope

These Terms and Conditions of Sale apply to sales of Color Prestige products by AMTS Prestige Enterprises Ltd (the “Seller”) to business customers acting in the course of their professional activities.

This website is not intended for consumers. Confirming an order constitutes acceptance of these terms, which prevail over any other document issued by the Customer unless the Seller agrees otherwise in writing.

2. Products

Our products are described with care on the website and include the Professional Colour Analysis Drape Set, containing 24 drapes and a pouch, as well as individual drapes.

Colour representation: colours shown on the website may vary depending on the characteristics and settings of each screen. The photographs represent the products but cannot guarantee a perfect colour match on every device.

Dimensions: the drapes measure approximately 60 × 45 cm. Slight variations in size may occur from one drape to another, in particular due to textile manufacturing tolerances.

3. Requests and orders

A request sent through the website is not binding. The Seller replies within 2 working days with the final amount, including shipping, and product availability. For 20 sets or more, or for delivery outside the European Union, the Seller issues a quote.

An order becomes binding when the Customer accepts the Seller’s quotation in writing by email. The Seller may decline an order if the products are unavailable or for another legitimate reason.

4. Prices

Prices are quoted in euros, excluding VAT and shipping. Set prices vary according to the quantity ordered, based on the pricing schedule displayed on the website when the enquiry is submitted.

For business customers established in another EU Member State with a valid EU VAT number, VAT is accounted for by the Customer under the reverse-charge mechanism. In all other cases, any applicable VAT is shown in the Seller's proposal.

Shipping costs are stated in the Seller's reply, before any confirmation.

5. Payment

Payment is made by bank transfer upon receipt of the invoice and before dispatch. The Seller’s bank details are provided by email only. If in doubt, the Customer should verify these details with the Seller before making a transfer.

Ownership of the products remains with the Seller until payment has been received in full.

6. Delivery

We deliver to France and other European Union countries. Deliveries outside the EU are subject to a personalised quote. In-stock products are dispatched within 3–5 working days of receiving payment. Dispatch times are estimates.

Risk passes to the Customer upon delivery. If a parcel arrives damaged or incomplete, the Customer must report the issue to the carrier and notify the Seller in writing within seven days of receipt.

7. Conformity and faulty products

The Customer must inspect the products upon delivery. Any defects, non-conforming products or items sent in error must be reported in writing, with photographs, within seven days of receipt.

Once the issue has been verified, the Seller will replace the affected product or, if replacement is not possible, issue a refund. In such cases, the Seller will cover the return shipping costs.

Products that meet the agreed specifications cannot be returned or exchanged solely because the Customer has changed their mind. Nothing in these terms affects any rights the Customer may have under mandatory applicable law.

8. Liability

The drapes are tools that support colour analysis: the outcome of an analysis depends on the judgement of the professional using them. To the extent permitted by law, the Seller's liability is limited to the amount of the order concerned.

9. Personal data

Customer data is processed in accordance with the website's privacy policy.

10. Governing law and disputes

These terms are governed by the laws of Cyprus, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna, 1980).

The parties will first seek to resolve any dispute amicably. If no agreement is reached, the courts of Cyprus shall have jurisdiction.

These Terms and Conditions of Sale are available in French and English. In the event of any discrepancy between the two versions, the French version shall prevail.
